
STARFLEET UNIFORM CODE OF JUSTICE
The Starfleet Uniform Code of Justice, referred to as the "SUCJ", was first published by the Legal Branch of Starfleet Administration in July 2141. The three main sections are the Establishing, Punitive, and Applicable Articles. The publishing of the SUCJ effectively removed members of the Earth Starfleet from the disciplinary control of UESPA.
Establishing Articles
These articles are established to regulate conduct within the Earth Starfleet, which is hereby declared as an independent and autonomous agency, adherent to its own regulations, and answerable to the authority of the United Earth government.
ARTICLE ONE: Subject Persons
These articles apply to active-duty members of the Starfleet and in certain cases as determined by Starfleet regulations members on inactive duty to which actions are deemed appropriate under these articles. For the purposes of these articles, all personnel listed as duties unassigned, temporary duty, or detached duty shall be considered to be performing active-duty service.
ARTICLE TWO: Definition
Starfleet personnel eligible for enforcement of these articles shall include those with the title "Commanding Officer", as referencing the commissioned officer in overall command of a Starfleet unit, and "Officer-in-Charge", who shall hold the authority of a Commanding Officer for the purposes of these articles. Other Starfleet officers may report individuals for violation of this code whereas Starfleet crewman may advise their superiors if a violation of these articles is witnessed.
ARTICLE THREE: Rights
All Starfleet personnel accused under these articles shall have the right to be notified of the charges against them, to face their accuser with cross examination, and to examine any evidence put forward in reference to the allegations. In cases where an accused shall be referred for a trial under the punitive section of these articles, the accused shall have the right to legal counsel of their choice or to be provided counsel if none is available.
ARTICLE FOUR: Apprehension
Personnel of Starfleet Security may, in the course of their duties, apprehend, question, and retrain persons who are accused of violation of these articles. In cases where an accused may be subject to questions, the accused shall have the right to remain silent, nor be compelled or forced in any way to provide incriminating evidence against themselves. An accussed shall further have the right to make a statement before questioning begins.
ARTICLE FIVE: Jurisdiction
These articles shall hold authority on any Starfleet installation, space vessel, or other such location as to which Starfleet is tasked with its administration. In cases where violation of these articles occurs outside of Starfleet authority, arrangement shall be made with civilian authorities to return the Starfleet member to the proper authority for investigation. The applicability of these articles shall not interfere or restrain local laws and customs, and Starfleet personnel shall be subject to local jurisdiction in all cases outside of Starfleet control.
Punitive Articles
Punitive enforcement of these articles shall be delegated to local commands or to a convening authority who shall initiate a courts martial procedure as prescribed by these articles.
ARTICLE SIX: Courts Martial
Starfleet personnel accussed under these acts shall be held to accountability for an appropriate courts martial as defined by the United Earth Military Manual of Courts Martial, first published in 2134. Courts Martial shall be composed as follows depending upon the nature of the accused's offense.
General Court Martial

A General Court martial shall be comprised of three officers of command rank, defined as Captain or above, with the senior officer appointed as President of the Court. A prosecutor, court reporter, and defense counsel shall be assigned in all cases. The accused shall have the right to challenge the prosecutor, any member of the court, or the President of the Court, should the accused feel that such persons harbor a prejudicial attitude towards their case.
Summary Court Martial

In cases where a General Court martial may not be practically convened, a Summary Court Martial may be established by a Commanding Officer in the rank of Captain or above, with the next two senior officers of the accused's command acting as co-members of the court martial panel. Additional officers shall be assigned as defense counsel and prosecutor, with appropriate administrative staff assigned as court reporter and to other such clerical duties as required. All summary court martials shall be subject to review or appeal.
Non-Judicial Punishment

In cases where the nature of the offense does not warrant the conveying of a court martial, the accused shall appear before their Commanding officer or Officer-in-Charge for non-judicial punishment under the provisions of these articles.
ARTICLE SEVEN: Applicability
Punishments and sentences imposed by either non-judicial punishment or courts martial shall be categorized in three levels as follows. Each senior level shall also have the authority to impose penalties of the previous levels.

LEVEL ONE: Penalties as determined by non-judicial punishment to include extra duty or restriction to quarters

LEVEL TWO: Penalties as determined by a Summary Court Martial to include terms of confinement not to exceed one year, reduction to the next lowest rank, or a recommendation for dismissal from the Starfleet.

LEVEL THREE: Penalties as determined by a General Court Martial to include long term confinement, expulsion from the Starfleet, reduction to the lowest possible rank, or death.

In addition to other punishments, a Commanding Officer or Officer-in-Charge may place a Letter of Reprimand in the formal service record of the accused. An accused may also select resignation in lieu of court martial when deemed appropriate by the conveying authority, followed by a General or Bad Conduct Discharge.
ARTICLE EIGHT: Appellate Authority
​All personnel subject to these articles shall have the right to appeal to the next higher authority to which the conveying authority is subject. In cases of non-judicial punishment, a trial by court martial may be requested in lieu when personnel are available to form a court; in all other cases, the results of a non-judicial punishment may be appealed to the authority to which the Commanding Officer or Officer-in-Charge may answer. An appellate authority shall review and may uphold, reverse, amend, or retry a case as appropriate.
